1. Acceptance of Terms

By accessing or using MyBid.Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

MyBid.Pro provides an AI-powered platform for home service professionals, including chatbot lead capture, voice assistant services, appointment scheduling, customer relationship management, and related business tools.

3. Account Registration

To use our Service, you must:

  • Be at least 18 years old
  • Provide accurate, complete, and current registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Be responsible for all activities under your account

4. Subscription and Billing

Subscription Plans

The Service is offered under two subscription plans:

  • Monthly Plan: $39/month base fee plus tiered per-lead charges
  • Annual Plan: $450/year base fee with 25% discount on per-lead charges

Per-Lead Pricing

Lead charges are calculated using volume-based tiers: $3.00 per lead for the first 50 leads, $2.50 for leads 51-150, $2.00 for leads 151-500, and $1.50 for leads beyond 500 per billing cycle. Annual subscribers receive a 25% discount on all lead tiers.

Billing

You will be billed in advance for the base subscription fee (monthly or annually). Per-lead charges are billed at the end of each billing cycle based on actual usage.

Cancellation

You may cancel your subscription at any time. For monthly subscriptions, you will retain access until the end of your current billing period. For annual subscriptions, you may request a pro-rated refund for unused months if canceling within 30 days of renewal.

Lead Disputes

You may dispute a lead charge within 7 days of the lead being created if you believe the lead was invalid (spam, duplicate, wrong number, etc.). Disputes are reviewed by our team within 5 business days. Approved disputes result in credit to your account or refund at our discretion.

5. SMS Communications

Customer SMS Notifications

Our Service may send SMS messages to your customers on your behalf for appointment reminders, confirmations, and other business communications. You are responsible for obtaining proper consent from your customers before enabling SMS notifications.

Compliance

You agree to comply with all applicable laws regarding SMS communications, including the Telephone Consumer Protection Act (TCPA) and state regulations. You must maintain records of customer consent and honor opt-out requests promptly.

Message Content

You are responsible for ensuring SMS content is accurate, professional, and does not contain prohibited content. We reserve the right to suspend SMS features if messages violate our acceptable use policies or applicable laws.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit spam, chain letters, or other unsolicited communications
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to harass, abuse, or harm others
  • Collect user information without consent
  • Use automated means to access the Service without permission

7. Your Data

Ownership

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a license to use Your Data solely to provide and improve the Service.

Responsibility

You are responsible for ensuring you have the right to collect, store, and process any personal data you submit through the Service, including obtaining necessary consents from your customers.

8. AI Services

Our AI-powered chatbot and voice assistant are designed to assist with lead capture and customer communication. You acknowledge that:

  • AI responses may not always be accurate or appropriate
  • You are responsible for reviewing and managing AI interactions
  • The AI should not be relied upon for emergency situations
  • You will configure the AI appropriately for your business

9. Intellectual Property

The Service and its original content, features, and functionality are owned by MyBid.Pro and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL MYBID.PRO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless MyBid.Pro and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may export your data before termination.

14. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Travis County, Texas.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
